When will the Dutch nuclear power plant Borssele close?

Situation still unclear after interim judgement

The question of when the only operating Dutch nuclear power plant, Borssele, will close is still uncertain after an interim judgement made today in a court case of the Dutch State versus the plant’s owners.

The case hinged on two issues. Firstly, did the Dutch government make an agreement with SEP (the association of electricity producers) that Borssele would close by 31 December 2003? There was no evidence of this given to the court on 22 June 2001, therefore the judge has told the Dutch government to provide evidence of the agreement. To this end, further witnesses will be heard on 9 November 2001.

Secondly, if such an agreement was made with SEP, is it also binding on the nuclear power plant’s current owner EPZ? In this case, the interim judgement was: yes, if an agreement was made with SEP then it is binding on EPZ. Therefore, it is sufficient to provide evidence that the Dutch government has agreed with SEP that Borssele must close by 31 December 2003.
